Introduction

Welcome to CourtPass! These Terms of Service ("Terms") govern your use of the CourtPass mobile application and website (collectively, the "Service") provided by CourtPass ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

CourtPass is a platform designed to facilitate league management for pickleball and other sports, including team rosters, schedules, availability requests, lineups, standings, and communication tools.

Acceptance of Terms

By creating an account, downloading the app, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

These Terms constitute a legally binding agreement between you and CourtPass. If you do not agree to these Terms, you must not access or use the Service.

Description of Service

CourtPass provides a comprehensive platform for sports league management, including but not limited to:

• Team and league creation and management
• Player registration and roster management
• Schedule creation and match coordination
• Availability requests and lineup setting
• Live standings and match results
• Team communication and announcements
• Payment processing for league fees and registration

The Service is available on iOS and Android devices, and we may offer web-based access in the future.

User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

Account Types

CourtPass supports different user roles including Players, Captains, and League Administrators, each with varying levels of access and responsibilities.

User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable laws or regulations
• Impersonate any person or entity or misrepresent your affiliation
• Upload, post, or transmit any content that is harmful, offensive, or violates others' rights
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to harass, abuse, or harm others
• Interfere with the proper functioning of the Service
• Collect or harvest data from the Service without permission

We reserve the right to suspend or terminate your account for violations of these rules.

Intellectual Property

The Service and its original content, features, and functionality are owned by CourtPass and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Service (such as team names, player information, or messages). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with providing the Service.

You must not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

Privacy

Payments and Fees

In no event shall CourtPass, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless CourtPass and its affiliates from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
